Terms of Use

TopPTE ("the Platform") is a PTE Core preparation platform offering practice across PTE Core question types, AI-powered scoring for speaking and writing, mock tests covering listening, speaking, reading and writing, and learning-progress tracking.

These Terms of Use ("Terms") apply to everyone who visits, accesses or uses the Platform.

The Platform is operated by PIXETORY, a sole proprietorship registered in Ontario, Canada. To contact us, email contact@toppte.com.

By accessing or continuing to use the Platform, you agree to these Terms. If you do not agree with any part of them, please stop using the Platform.

Some features, including viewing individual questions, AI scoring, practice history, word lists and other learning tools, require an account.

You must provide a valid email address when registering and are responsible for activity that takes place through your account.

You agree that you will:

• keep your password and account credentials secure and not share your account with others;
• not use automated scripts, bots, crawlers, scraping tools or similar methods to collect or bulk-download content from the Platform;
• not decompile, reverse engineer, reproduce, copy, redistribute, resell or make unauthorized commercial use of the Platform's content, question bank, interface, software or code;
• not attempt to bypass access restrictions, usage limits or security measures;
• not use the Platform for unlawful purposes or in any way that infringes the rights of others.

If we reasonably believe that you have breached these Terms, misused the Platform or created a security or operational risk, we may suspend or terminate your account or restrict your access to the Platform, to the extent permitted by applicable law.

Some question types and features are available to free users in limited quantities. Premium membership provides access to all available Premium questions and features for the membership period purchased.

AI speaking and writing scoring is provided for normal personal exam preparation by registered users. To keep the service stable and prevent abuse, we may apply rate limits, queuing or other reasonable technical limits to scoring requests that are automated, unusually frequent or clearly beyond the range of normal personal preparation.

Membership is a one-time, fixed-duration purchase and does not automatically renew. Your Premium access ends automatically when the purchased membership period expires, so there is nothing you need to cancel.

Premium benefits are normally activated immediately after successful payment.

Payments are processed by our third-party payment provider, Stripe. The Platform does not store your full payment card details.

Prices are displayed in Canadian dollars (CAD), unless otherwise stated. Before completing your purchase, the checkout page will show the selected membership duration and total amount. Please review this information carefully before submitting payment.

Except where required by applicable law, membership purchases are generally non-refundable once Premium access has been activated.

However, you may request a refund in the following circumstances:

• Duplicate charge or payment error: a payment-system error results in the same order being charged more than once, or the amount charged differs from the amount displayed at checkout;
• Service unusable: a technical issue with the Platform leaves you completely unable to access or use the Premium features you purchased, and we are unable to resolve the issue within a reasonable period;
• Accidental purchase: you contact us within 24 hours of purchase and have not used any Premium-only features, including viewing paid questions or using Premium AI-scoring features.

To request a refund, email contact@toppte.com and include your account email address, order date, amount paid and the reason for your request. For duplicate-charge requests, we may ask you to provide proof of the charge.

We aim to respond to refund requests within 5 business days.

Approved refunds will be issued to the original payment method. The time it takes for the refund to appear may vary depending on Stripe, your bank, card issuer or payment provider.

When a refund is processed, the corresponding Premium membership benefits may be cancelled or removed.

Nothing in this Refund Policy limits any rights you may have under applicable consumer protection laws.

The Platform's speaking and writing scoring features use artificial intelligence, including third-party speech-recognition and large language model technologies.

Scores, sample feedback, estimated score ranges, estimated CLB equivalents and CRS-related reference information are provided for practice and informational purposes only. They are intended to help users understand their current performance and identify areas for improvement.

AI-generated scores and feedback:

• do not represent official PTE scoring;
• are not issued or verified by Pearson;
• may differ from scores awarded in an official PTE examination; and
• do not guarantee or predict any particular exam result, CLB level, CRS score or immigration outcome.

The Platform provides practice materials designed around PTE Core question formats and exam-style content.

TopPTE is an independent preparation platform and is not affiliated with, endorsed by, sponsored by or authorized by Pearson.

References to PTE, PTE Core, Pearson or related examination terminology are used only to identify the examination for which the Platform provides independent preparation services.

The Platform's original interface design, software, code, content organization, compiled question bank, AI-scoring logic, learning tools and related materials are protected by applicable intellectual property laws.

Unless otherwise stated, these materials are owned by PIXETORY or are used under valid licence or other lawful authorization.

You may use the Platform and its content only for your personal, non-commercial study and preparation.

Without prior written permission, no individual or organization may reproduce, scrape, republish, redistribute, sell, sublicense, commercially exploit or systematically copy the Platform's content, question bank, interface, software or related materials.

Any recordings, written responses or other content you submit to the Platform are handled as described in our Privacy Policy.

We aim to keep the Platform available, reliable and accurate, but we cannot guarantee uninterrupted or error-free service.

The Platform may occasionally be unavailable or affected by circumstances including maintenance, software errors, internet or network failures, user-device issues, third-party service-provider failures or events beyond our reasonable control.

To the maximum extent permitted by applicable law, we are not responsible for losses or damages arising solely from:

• temporary service interruptions or technical failures beyond our reasonable control;
• loss, delay or temporary unavailability of data caused by technical failures or events beyond our reasonable control;
• reliance on AI-generated scores, feedback, estimated score ranges or other practice information;
• differences between performance on the Platform and results obtained in an official PTE examination; or
• any particular exam, immigration, academic or professional outcome not being achieved.

The Platform is provided as a preparation and practice service and should not be treated as an official testing, immigration, legal or educational-advisory service.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

We may update the Platform, its features, pricing, membership options or these Terms as the service evolves.

When these Terms are revised, the updated version will be posted on this page together with a revised "Last updated" date.

Revised Terms will apply from the date stated in the updated version.

Where a change materially affects existing paid membership benefits, we will provide reasonable notice where required by applicable law.

Your continued use of the Platform after revised Terms take effect constitutes acceptance of the updated Terms.

We may also discontinue, replace or modify individual features where reasonably necessary for technical, security, operational or business reasons.

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Nothing in this section limits any mandatory consumer protection rights or other legal rights that may apply to you under applicable law.
